Amber Heard wants Johnny Depp’s US Defamation Case thrown out

Actress Amber Heard has called for the ongoing defamation case against her, worth £50 million, to be dropped. This is after her ex, and alleged domestic abuser, Johnny Depp lost a libel case against The Sun last year.

Mr Depp started legal proceedings against Ms Heard last year. He is suing her for defamation of character over an article she wrote in 2018. In this article, although she does not name Mr Depp, she claims to be a victim of domestic abuse. Subsequently, Warner Bros. asked for Johnny to resign from the Fantastic Beasts franchise.

The lawsuit, which is due in court in 2022, states the claim also cost him his role in Pirates of the Caribbean.

Johnny Depp recently lost a libel case against newspaper The Sun. In an article, The Sun claimed he had assaulted his then wife. Johnny refuted these claims, but Judge Mr Justice Nicol found them to be “substantially true”. He was then ordered to pay The Sun £630,000 to cover their legal costs.

Ms Heard said this loss proved that she was a domestic abuse victim. Her legal team added that Johnny’s loss against The Sun means he can not say her claims are untrue. As such, his claims are barred under Virgina Defamation law. As he can not act on any of the claims made, Ms Heard wants the case to be thrown out in its entirety.

Amber has requested to meet with a judge next month to formally ask for this dismissal.

When Johnny and Amber met on the set of The Rum Diaries, no one could have predicted they would be the most talked about couple. In 2011, Johnny was with long term love Vanessa Paradis while Amber was with girlfriend Tasya van Ree. In June 2012, Vaness and Johnny declared their 15 year relationship over, just months after Amber had split with Tasya.

The notoriously private couple both wanted to keep relationship out of the spotlight, attending events alone before meeting up afterwards. In 2014, they became engaged with Amber showing her ring off at the premiere of Three days to kill.

In 2015, the officially married in a private ceremony on Johnny’s island. The leaked picture shows the day as idyllic, yet just a year later Amber announced they were divorcing.

On May 23rd 2016, Amber told the world she was filing for both a divorce and a restraining order. She claimed the Oscar winner had abused her throughout their relationship, often when under the influence. A settlement was reached with Amber who no longer wanted a domestic violence restraining order or her spousal support of $50,000 a month. Depp paid $7 million, which Amber donated to charity.

In 2017, a year after first filing, the couples marriage ended. The couple released a statement saying there relationship was volatile and passionate, but bound by love. A non disparagement clause added to the divorce, prevents either party from saying anything negative about the break up or relationship.

An article by Amber, written in 2018, seemed to break this by declaring herself a victim of domestic abuse. She never used his name but Depp, however Warner Bros relinquished his role from Fantastic Beasts 3. He also claims it cost him the returning role of Captain Jack in Pirates of the Caribbean.
